Shop in a Residential House in Patna: Master Plan Mixed-Use Rules
Quick answer
Patna's residential areas allow everyday shops and services. But a shop inside your house depends on the road and the plot size.
- Shop inside a house: a road of 40 ft or more and a plot of about 4 kattha or more.
- 17 roads, such as Bailey Road and Boring Canal Road, are commercial strips.
- Show the shop on the plan; holding tax is at the commercial rate.
Which rule fits your lane? See the table below.
A shop at home: first find which rule you fall under
Land use in the Patna Planning Area is set by the Patna Master Plan 2031. For a shop there are four situations:
| Your situation | What the master plan says |
|---|---|
| Everyday shop or service in a residential zone | On the list of "uses permitted" (full list below). |
| House and shop in one building (mixed use) | Road of 40 ft or more, a minimum plot size and a cap on the shop area. Needs the Authority's approval. |
| Plot on a commercial strip road | Commercial zone rules up to 150 m on both sides of the road. |
| Retail market, shopping centre, restaurant, vehicle garage | In a residential zone only with the Authority's special approval. |
How to find your land's zone: Patna Master Plan 2031 explained.
Which shops and work are allowed in Patna's residential areas?
The master plan's zone table lists these among the "uses permitted" in the residential zones (R1, R2):
- Convenience shopping (everyday shops).
- Services for households: salon, parlour, bakery, sweet shop, dry cleaning, stationery, tailoring, internet kiosk.
- Customary home occupation, and household industry with up to 10 employees, without service or storage yards.
- Doctors' clinics, professional offices, banks.
A retail market, retail shopping centre, restaurant or motor repair garage is in a different class. The Authority allows these only on "special appeal".
Note: this list says what activities an area can have. Turning part of a house into a shop is mixed use, and its conditions are below.

Turning part of your house into a shop: mixed-use conditions
The master plan allows mixed use only on plots facing a road at least 40 ft wide. On top of that, there is a plot size and a cap on the shop area:
| Road width | Minimum plot | Shop/commercial part (of total built-up area) |
|---|---|---|
| 12 m (about 40 ft) | 500 sq m (about 4 kattha) | Up to 20% |
| 18 m (about 59 ft) | 1,000 sq m (about 8 kattha) | Up to 30% |
| 30 m or more (about 98 ft) | 1,500 sq m (about 12 kattha) | Up to 40% |
- The house stays the main use. At least 60% of the floor area must be residential; the shop can't exceed 40%.
- FAR stays residential. A shop doesn't earn you extra floors.
- Parking and open space follow commercial rules. With a shop, parking is set by the byelaws' commercial norms.
- Ask the plan office about setbacks. The report says residential setbacks in one place and commercial in another.
- Approval is required. Mixed use needs the Authority's approval.
So a 2–3 kattha house on a 20 ft lane does not fit this table. Before building a separate shop there, ask the plan-approval office in writing. To convert kattha and square metres: kattha converter.

Patna's commercial strips: 17 roads with different shop rules
These roads grew as markets over the years. The master plan marks them as commercial strips. Commercial zone rules apply up to 150 m on both sides of the road. The road must be at least 18 m wide.
| Road | Proposed width |
|---|---|
| Hathiakan Road | 30.5 m |
| Danapur–Digha Road | 27.4 m |
| Khagaul Road | 30.5 m |
| Bailey Road | 60 m |
| Ashiyana–Digha Road | 27.4 m |
| Rajeev Nagar Road | 27.4 m |
| PNM Mall Road | 18.3 m |
| Alpana Market Road | 18.3 m |
| Gosain Tola Road | 18.3 m |
| Mainpura Road | 30.5 m |
| Boring Canal Road | 27.4 / 30.5 m |
| SK Nagar–Kidwaipuri | 18.3 m |
| NH-98 (Bypass) | 60 m |
| Patna–Khagaul Road | 30.5 m |
| Patna–Gaya Road (Budh Marg) | 30.5 m |
| Mithapur bus stand | 60 m |
| Chhoti Pahadi Road | 60 m |
- Commercial hubs: proposed at junctions of the new 80, 60, 45 and 30.5 m roads. Where those roads run: Patna's 80 m and 60 m roads.
- The map sets the boundary. Check on the master plan land-use map whether your plot falls inside the strip.
The widths in the table are proposed. If the road is narrower today, widening could take the front of a plot. Ask about that before you buy. Road-wise widths: Patna road widening list.

What about a shop running since before 2016?
The Patna Master Plan 2031 came into force in October 2016. A use that was lawful before that can continue. But a use that no longer fits the zone cannot be extended or enlarged. Rebuilding brings the new rules.
Before you build or open the shop: plan, tax, licence
| Item | What to know |
|---|---|
| Building plan (naksha) | Show the shop on the plan. The permit fee for the non-residential part is double the residential rate. Full process: building plan approval in Patna. |
| Holding tax | For the commercial part, carpet area is taken as 80% of built-up area (70% for residential). The ARV rate also changes with use. A rented-out shop gets a factor of 1.5. Details: Patna holding tax. |
| Trade licence | The municipal tax portal has "Trade Services" with new licence and renewal. On 31 October 2026 the form was not opening. Ask the Patna Municipal Corporation what your trade needs. |
| Shop on farmland | Changing the land's class to commercial needs a registered Conversion Deed: 7% + 2% of the MVR difference. Details: land conversion repealed: the new rules. |
What should you do?
- Confirm the zone and the road width first. The shop decision follows from these two.
- Buying a house to run a shop? Check the plot size. A plot under 500 sq m (about 4 kattha) does not fit the mixed-use table.
- Get the shop shown on the approved plan. An unapproved change of use can cause trouble at resale and with loans.
- Declare the use correctly for holding tax. Wrong details can bring a penalty later.
- Get the office's answer in writing. Don't invest on a verbal "it'll be fine".
Shop in a residential house in Patna: FAQs
- Can I open a shop on village abadi land?
The Patna Planning Area has a Village Settlement zone. Its uses permitted "within village area" include retail shops, restaurants, banks, personal services and repair shops. Traditional household industries too. The building plan rule still applies.
- Will renting out the ground-floor shop raise my holding tax?
Yes. In the corporation's method, a rented part has an occupancy factor of 1.5, against 1 for self-use. The commercial part's carpet area and ARV rate are also counted differently.
- If my plot is on a commercial strip road, can the whole building be shops?
Commercial zone rules apply there, and they cover shops, offices and showrooms. FAR, parking and setbacks come from the byelaws. Show the plot as commercial use when you apply for the building plan.
- Are the new 2026 byelaws changing these rules?
The Bihar Building Byelaws 2026 are still a draft. We found no final notification up to 31 October 2026. If the rules change, this article will be updated.
