Where It Goes Wrong

Where registries go wrong in Patna

None of these show up on the day of registration. They appear when you try to sell, mortgage, or defend the property — usually years later, when the other side has moved on.

⚠️
The deed is a template with the names changed

Drafts given by brokers often leave out the lines where the seller promises the title is clean and agrees to pay you if it is not. Without these lines, you have nothing in writing against the seller if a co-owner, a hidden bank loan or a family partition case comes up after the registry.

📋
Duty is computed on the wrong MVR category

Bihar's MVR (Minimum Value Register) has different rates for each mauza and each land type — main road, branch road, residential, commercial, agricultural. If the wrong type is used, too little stamp duty is paid, and the case can be opened again later with a penalty.

🙈
Nobody explains what you are signing

With the queue, the fingerprints and the clerk's questions, first-time buyers sign whatever they are given. Points like how the money is paid, the possession date and who pays old dues are often read for the first time months later — usually during a dispute.

Deed Check

What we check in your deed

Before you sign, each document below is read against your actual parent deed and revenue record. If a new deed has to be drafted, we tell you what it must contain and can put you in touch with a lawyer — their fee is told before work.

📝
Agreement to Sell (Ikrarnama)

Payment dates and amounts. How much of the token is lost or returned, written as a clear amount. The seller's duty to clear any loan or charge and update the jamabandi before the sale deed is signed. And a written way out for you if a problem in the title is found during this time.

🏠
Sale Deed (Kewala / Bainama)

Boundaries on all four sides, khata and khesra (plot) number, thana number and mauza, area in the same unit as the seller's old deed, full payment details with how each amount is paid, and the seller's written promise that the title is clean — with a promise to pay you back if it is not.

🎁
Gift Deed & Family Partition (Bantwara)

Checked so the relationship and share of each family member is stated clearly, with the supporting documents the Sub-Registrar will ask to see attached correctly — the most common source of later family disputes over ancestral land.

📋
Other papers

Power of Attorney for sellers living outside Bihar or abroad, release deed (when a family member gives up their share), correction deed (to fix a mistake in a deed that is already registered), and possession letters.

Stamp Duty & Savings

Stamp duty and MVR (circle rate)

Duty is charged on the higher of the MVR value and the agreed price. Check these before the deed is drafted — they cannot be fixed after registration.

What we check before stamping

  • Rates since 18 June 2026: Stamp duty is 7% and the registration fee 2% — 9% in all. When a man sells to a woman it is 6.6% + 1.9% (8.5%); when a woman sells to a man, 7% + 2.1% (9.1%). Anyone quoting "6% + 2%" is using the old rate.
  • Women buyers: Buying from a male seller in a woman's name costs about 0.5% less. For a joint purchase (for example husband and wife) the notification is not explicit, so we get the sub-registry office's answer before the deed is drafted.
  • MVR category: The Minimum Value Register rate depends on the mauza and the land category (main road, branch road, residential, commercial, agricultural). We check the exact category, not an estimate from the colony name.

Rates, ceilings and concessions change by government notification. We verify the current position for your specific transaction before you pay. Stamp duty and registration fee are paid in the buyer's own name, directly to the government — we never handle your funds.

Coverage

Which Sub-Registrar office covers your property

Jurisdiction follows the property, not your address. Presenting a deed at the wrong office wastes a slot and a day — we confirm the correct office before anything is booked.

Simple Process

How the work runs — 4 steps

You know the cost before anything is paid, and nothing is signed until you understand it.

1
First look is free
Send the papers

Share the previous title deed, Jamabandi / rent receipt (lagaan rasid), Khatiyan or LPC if available, and the agreed price and payment terms — on WhatsApp. We read the parent deed and the Jamabandi first, because most registry problems are already visible there.

2
Before you sign
Draft checked

We read the agreement or sale deed draft line by line — boundaries, khata-khesra, area, payment terms, the seller's promise of a clean title — and tell you clearly what must change before anyone signs.

3
Checked against the MVR
Duty and office

We check the Minimum Value Register (MVR) rate for your mauza and land category, work out the duty on the higher of the MVR value and the agreed price, and confirm the correct registry office before the slot is booked on e-Nibandhan.

4
No surprises
Registry day

We tell you in advance what happens at the office — Aadhaar e-sign, photo and biometrics, witnesses — and what to carry, so there are no surprises on the day.

Send us the parent deed first

Most problems are already visible in the previous title document. Share it on WhatsApp — we will tell you what needs fixing before you pay a token. No charge for the initial review.

Why It Matters

What changes when a professional handles it

A plain comparison of how the same registry runs three different ways.

Comparison: broker-arranged vs self-managed vs with PP Properties

Women buyer rate Rarely raised Missed if you did not know to ask Lower duty for women buyers checked and applied
Registry day You are handed to a tout You queue and guess You know every step and paper in advance

FAQs

Frequently asked questions

Answers to what buyers ask before a Patna registry.

It depends on where the land physically sits — its mauza and thana number — not on where you live. Patna district has several registry offices covering different areas, and registering at the wrong one is a common cause of rejection. We confirm the correct office from the mauza and thana number in the parent deed before booking any slot.
Since 18 June 2026, a sale deed anywhere in Bihar carries 7 percent stamp duty and a 2 percent registration fee — 9 percent in all. When a man sells to a woman it is 6.6 + 1.9 percent (8.5 percent), and when a woman sells to a man, 7 + 2.1 percent (9.1 percent). Duty is calculated on whichever is higher — the value under the Minimum Value Register (MVR) or the agreed price — and the MVR itself was raised in June 2026 (1.6 times in rural areas, 2 times in urban and peripheral areas), so the MVR category of your plot matters. Rates change by notification, so we verify the current position for your specific transaction before you pay.
It should be. If the running Jamabandi (revenue record) is not in the seller's name, you can face problems at registration and later at dakhil-kharij (mutation), because the revenue record and the deed will not match. We check the Jamabandi on Bihar Bhumi (and at the Circle office where needed) before the deed is drafted, and tell you what needs to be fixed first.
An Agreement to Sell is a promise between buyer and seller, but under Section 54 of the Transfer of Property Act it does not make you the owner — only a registered sale deed does that. The agreement protects your right to hold the seller to the deal and to get your token back on the terms written in it. That is why the token and refund terms must be written clearly, with amounts.
Usually a deed writer (kaatib) or a lawyer. We read the draft against your parent deed and revenue record before you sign and tell you what must change. If you want a lawyer to draft it, we can put you in touch with one; the lawyer's fee is told before work. PP Properties does not practise law; if a matter turns into a court case, we say so plainly.
The registering officer can refer an undervalued document for valuation, and the deficient stamp duty can be recovered later along with a penalty. These notices can arrive long after registration, by which time the seller is unreachable. Getting the MVR category right on the day is considerably cheaper than defending a deficiency case later.
We explain the steps after the registry — applying online on Bihar Bhumi, which Circle (Anchal) office handles it, the documents to attach and the realistic timeline. Our free dakhil-kharij guide covers it in detail. Registration transfers title; dakhil-kharij updates the revenue record so the Jamabandi runs in your name for rent receipts, loans and future sale.
Yes, but the Power of Attorney must be made and attested the right way, or the registry office will not accept it. It is signed before the Indian Consulate or apostilled (depending on the country), and then stamped in Bihar within the set time after it reaches India. A wrong POA is a common reason a registry slot gets wasted. We check the POA before the slot is booked.

Useful resources

PP Properties is a property advisory firm and does not practise law or represent clients in court; where a lawyer is needed, we say so. Stamp duty rates, circle rates and concessions are set by the Government of Bihar and change by notification — figures on this page are indicative and are checked against the current notification for each transaction. Nothing here is legal advice.
